Hearing on constitutionality of RCCC resumes

The hearing regarding the constitutionality of the controversial Royal Commission of Corruption Control (RCCC) resumed at the Supreme Court on Sunday.

Lawyers pleaded on behalf of the government on Sunday.

Lawyers have already pleaded on behalf of the petitioner in a case filed by advocate Santosh Kumar Mahato challenging the constitutionality of RCCC.

Pleading on behalf of the government, former Attorney General Prem Bahadur Bista and senior advocate Kunj Bihari Prasad Singh stated the Commission would be dissolved automatically after the reinstatement of the parliament.

They added the question should not be raised about the Commission formed using the royal prerogative.

A five member special bench of the Supreme comprising justices Justices Kedar Prashad Giri, Min Bahadur Rayamajhi, Ram Nagin Singh, Anup Raj Sharma and Ram Prashad Shrestha is examining the case.

The King formed the RCCC under Article 127 of the Constitution of the Kingdom of Nepal 1990 to look after the cases relating to corruption and irregularities after the royal takeover of February 1. nepalnews.com pb Nov 13 05
