Separate writs filed for release of Deuba, Singh

Former Prime Minister, Sher Bahadur Deuba.

Two separate habeas corpus petitions were filed at the Supreme Court on Friday seeking the release of former Prime Minister Sher Bahadur Deuba and former minister Prakash Man Singh who have been detained on corruption charges.

Advocates Binod Karki and Sarvagya Naya jointly filed the petitions challenging the decision of the Royal Commission for Corruption Control (RCCC) on Deuba and Singh.

Deuba and Singh are serving two-year jail term each after being convicted of irregularities in the Melamchi Drinking Water Project.

The petitioners claimed that the formation of the RCCC was illegal as the King did not have authority to form such a body under Article 127 of the constitution.

The hearing of the case will start from Sunday.

The writ petition also demanded to declare all the decisions of the commission void as the anti-corruption body has been working against ‘natural justice’ by investigating, prosecuting, and making decisions on cases all by itself.

“Since the royal commission spends money without getting it sanctioned by the parliament, it must be declared unconstitutional,” reports quoted the petitioners as saying.

His Majesty the King Gyanendra formed the controversial commission to look after corruption cases following his February 1 takeover.

The RCCC was formed even as there is a constitutional body, the Commission for Investigation of the Abuse of Authority (CIAA), to look after irregularities and corruption related cases. nepalnews.com pb Sep 17 05
