SC allows parliament to decide on misuse of fund

The Supreme Court (SC) has said that the reinstated House of Representatives could decide any case of misuse of state fund.

Acting upon a case regarding the misuse of Prime Minister’s Relief Fund, the SC said since the House of Representatives has been reinstated, it could decide any case of misuse of the fund.

A full bench comprising Chief Justice Dilip Kumar Paudel and Justices Khil Raj Regmi and Gauri Dhakal issued the verdict on a writ petition seeking necessary legal arrangement to control the ‘misuse’ of the Prime Minister’s Relief Fund.

The petition was filed after the Cabinet led by Prime Minister Sher Bahadur Deuba distributed Rs 4.1 million to near and dear ones of the ministers in 2004 as Dashain allowance.

The bench also held Clause 2(2) of the Administrative Works (Regulation) Act 2013 BS as inconsistent with the 1990 Constitution, which was rendered null and void as per the Article 131 of the Constitution. nepalnews.com pb May 26 06
