CVICT welcomes SC verdict in favour of torture victims

Centre for Victims of Torture (CVICT) Nepal, a non governmental organization working for the treatment and rehabilitation of torture victims, has welcomed the verdict of the Supreme Court to make the concerned office at defendant in the case if the person involved in giving torture was not identified.

Acting upon a writ petition filed by Meghnath Sharma of Bharatpur municipality of Chitwan district, a joint bench of Justices Khil Raj Sharma and Pawan Kumar Ojha issued the verdict.

The apex court also said that cases could be filed at the Court even if it demanded compensation more than the amount mentioned in the existing laws.

Sharma filed a case at the apex court after the Kaski district court refused to file his case about the torture inflicted to him by the security personnel saying the perpetrator was not identified and the case demanded more compensation than the amount mentioned in Torture Compensation Act 2053 BS. The Appellate Court Pokhara later upheld the verdict of district court.

Issuing a press statement, CVICT said that the verdict will preserve the rights of the victims to get justice.

Chairman of CVICT, Dr. Bhogendra Sharma has said that the verdict will be helpful in legal fight in favour of victims of torture and against the perpetrator. nepalnews.com pb Nov 26 06
