PM urges SC not to test the legality of house proclamation
Prime Minister Girija Prasad Koirala has urged the Supreme Court (SC) not to test the legality of the historic May 18 declaration of the parliament under the 1990 constitution saying the declaration is a “separate constitution” covering several subjects.
Koirala also claimed that the declaration is a historic rights document. The PM added that the declaration is a “superior document” to the 1990 Constitution.
“This is a historic document passed in a special situation after the success of Jana Andolan (People's Movement) II that restored the House and which had passed the declaration to institutionalise the achievements of the movement,” said Koirala while submitting a written reply to the SC.
Koirala sought the SC’s order to quash writ petitions filed by advocates Achyut Prasad Kharel, Shree Prasad Upadhyay, Amita Shrestha and Arun Subedi demanding judicial review of the declaration.
Earlier, sending written reply to the Apex Court, Speaker of the House of Representatives Subash Chandra Nemwang also claimed that the court did not have the rights to test the historic proclamation of the parliament. nepalnews.com pb Nov 28 06
