Six government attorneys file petition challenging the appointment of Judges
Six government attorneys have jointly filed a writ petition at the Supreme Court against Chief Justice Dilip Kumar Paudel and the judicial council challenging recent appointment of 51 district court judges.
They charged that the CJ and the judicial council appointed 51 district court judges “unconstitutionally and violating the historic declaration of the House of Representatives”.
They have accused the Chief Justice and the Judicial Council of appointing the district judges without following the process required by the Constitution of 1990 and violating the House declaration, reports said.
Those attorneys who filed the case are, Badri Prasad Oli, Dhruba Kumar Bhattarai, Medini Prasad Paudel, Rajan Prasad Bhattarai, Ganesh Babu Aryal and Surya Prasad Pokhrel.
They claimed that the appointment of the judges’ in such a way is nothing but an attack on independent of the judiciary by the judicial leadership and added that the authorities followed neither transparency nor provided chances for competent people to give candidacy.
The Chief Justice had appointed the district judges on July 7 on the recommendation of the Judicial Council.
They claimed that the CJ has no authority to appoint judges after the House declaration as the House had not delegated such a power to the CJ.
The attorneys also claimed that those who were appointed s judges have not much experience, and knowledge and some of them are junior than the writ petitioners.
The Chief Justice, members of the judicial council, Kedar Prasad Giri, Min Bahadur Rayamajhi, Law Minister Narendra Bikram Nembang, and Bhairav Prasad Lamsal have been made defendants in the petition along with all the recently- appointed district judges. nepalnews.com pb Sep 16 06
