CJ against the idea of constitutional court

Chief Justice Ram Prasad Shrestha has said the provision of two courts at federal level would invite problems and delay justice to people.

Speaking to reporters at Tribhuwan International Airport (TIA), Kathmandu Monday CJ Shrestha said, history has shown two courts at the centre will create more confusion.

There could be clash of interest between the two courts and the service delivery will be delayed as some issues are taken by the constitutional court and some by the supreme court, said Shrestha.

CJ Shrestha cited the example of South Africa saying the justice delivery there gets delayed due to the provision of two courts.

Shrestha further said, the federal judicial structure like the ones in India and Pakistan would be most suitable for Nepal.

The sub-committee under the Constitutional Committee had forged a consensus among the political parties to have two courts - constitutional and supreme - at the federal level. nepalnews.com
