CJ as govt head: Proposal executable, say legal experts
The sitting Chief Justice can be appointed chief of a transitional government through an amendment to the constitution, legal experts have told leaders of Nepali Congress, UCPN (Maoist), UML and Madhesi Morcha.
Lawyers and legal scholars, who held a discussion with the top leaders at the Prime Minister's Office in Singha Durbar, said that the President would have to issue a decree to remove constitutional hurdles to implement the proposal.
We have suggested that the constitutional provisions which do not allow for the CJ to be appointed government chief be amended, said former Attorney General Yubraj Sangraula. He added that the parties should take special measures to not to drag the judiciary into controversy.
