The legal experts have suggested President Yadav that chief of one of the major state organs-legislative and judiciary- could be delegated as an acting head of state by issuing an ordinance. The Prime Minister cannot be delegated such authority as he is also the executive head of the country and making him the head of the state would breach the principle of power separation, legal experts said.
The present constitution does not have any provisions about it as it does not envisage such situation.
President Yadav has not visited any foreign country since being elected as the President. His proposed trip to India and China was postponed after the vice president’s controversial case.
Indian President Pratibha Patil has invited him to visit India. Foreign affairs experts say, a foreign visit is necessary for President Yadav to give a message to the world about the changes in Nepal as the first President of the country. nepalnews.com
