CIAA moves Supreme Court against Special Court orders

The Commission for the Investigation of Abuse of Authority (CIAA) has moved the Supreme Court against the Special Court's decision of releasing those accused in corruption case on the condition of reporting back to the Court on a given date, instead of remanding them to judicial custody during the investigation.
    
CIAA Secretary Keshav Prasad Bhattarai filed an application at the Supreme Court on Tuesday seeking that the apex court annul the undue order of the Special Court and issue order requiring the accused in the corruption case into judicial custody pending investigation.
    
The CIAA had filed cases against the Vice Chancellor of the Purbanchal University Dr Maheshwar Man Shrestha, Registrar Niroj Raj Pandey, Dean of the Faculty of Management Shyam Bahadur Katwal, Dean of the Faculty of Law Shambhu Prasad Koirala, Dean of the Faculty of Science and Technology Shuva Narayan Pathak, Controller of Examinations  Mohan Bahadur Basnet and Associate Dean of the Faculty of Science and Technology  Rajesh Kumar Jha.
    
However, a bench of the Special Court comprising chairman Kedar Prasad Chalise and members  Mohan Raman Bhattarai and Bhupendra Prasad Rai last Thursday had ordered that the defendants be released on due date and action initiated against them.
    
CIAA has determined Rs 42.87 million as the amount embezzled by the accused and sought a fine of that amount from them as well as imprisonment of one and half year to 11 years against them.
