Court rejects cabinet decision to withdraw Dhamala's case

The Kathmandu District Court (KDC) has rejected the cabinet decision to withdraw charges against president of Reporters Club Rishi Dhamala and two other journalists on Friday.

Stepping on a precedent set by the Supreme Court that subjudice cases cannot be withdrawn partially, a single bench of Shekhar Poudel of the KDC declared the cabinet decision was unacceptable.

A cabinet meeting on September 20 had decided to withdraw charges against Dhamala, Ram Suvak Mahato and Birendra KM. However, the cabinet had not decided anything about the charges against the fourth person Manoj Mahato on the same case.

Mahato and KM, who were brought to the court Friday for hearing, were taken back to the detention centre in Dillibazaar after the court refused to free them. Whether to allow the withdrawal of the case or not will be decided when the government revises its decision, the court said.

According to existing provisions, a subjudice case can be withdrawn only after the approval of the court hearing the case.

Dhamala was arrested on February 3 from his office in Putalisadak for his alleged connection with Ranavir Sena, which was involved in various riminal activities including bomb explosions, extortions, kidnapping and murders. He was later freed on bail.

His case was withdrawn on September 20, one day before Prime Minister Madhav Kumar Nepal left for New York, USA, leading the Nepali delegation to the 164th UN General Assembly. Dhamala was also part of the delegation.

Sources say, the very reason for withdrawing Dhamala's case was to enable him to go to the US. The cabinet had taken the decision under pressure from foreign minister Sujata Koirala. Dhamala is known to have close ties with Koirala. nepalnews.com

A man is innocent until convicted by the court. So at this stage Dhamala is not
a criminal YET.

It is true that Journalists must have contacts with many
different people in order to do theit job. The case is confussing.

But in
this case the charges are so serious that they must be tried in court.

I
think that Sujata Koirala was very foolish to try to withdraw this case and she
has damaged the reputation of the NC and the government. I think she has over
estimated her power, and maybe she should be removed from her post.

its not a good idea, the cabinet dealing with a local issue. sounds suspicious,
the government. they should be dealing with higher issues, like making the
consution, for example????

Thanks to the judge and keep it on.
What we can expect from these corrupt
leaders including Makune and Sujata? No need to be surprised even if we hear
that the cabinet of loosers decided to declare Nepal as a part of India.
But
one day, they will be definately punishe for that.

The reality is that, the main key for the law is with uncivilized, uncultivated,
third cl politicians hand. Unless law will be on top of every one, Nepal will be
the same, where a aangutha chap politician will be a judge to favor himself. Why
just Dhamala to US?? There is no lack of intellectual people in Nepal.
Good to

Dhamala must be rejected by all Journalism professional ociations, insutions as
he has made a shame to everyone by supporting and leading a terrorist group.
People' like Dhamala should nt' be allowed to be a member and take part in any
public positions or activities and as far as possible, he must be put into jail
for the rest of the life. Only then Nepal's security/ legal insutions will be
considered capable and fair. When a simple common Nepali will be centenced to
death jain penalty for similar crime, why Makune and other UML leaders are ready
to forgive him. this encourages impunity and Nepali leaders are the root cause
for promoting such impunity, so in fact neapl's netaji's must all be hanged by

First, i would like to congratulate the cort for rejecting the cabinet's
decision to withdraw charges against president of Reporters Club Rishi Dhamala.
What a shame for Nepal that the last insution of justice- The court, is also
being tried to make corrupt like corrupt political system and politicians.
The
court should keep on discourasing the decision of such a cabinet.
The decision
of cabinet shows that there is very complicated network of politicians
especially high rank with criminal groups.
