PM not eligible to stay in power: Amicus Curiae Ghimire

In regard to the dissolution of the House of Representatives (HoR), Amicus Curiae member Komal Prakash Ghimire said that the Prime Minister should not stay in power even a single minute after failing to get the vote of confidence from the parliament.

Ghimire, who is also a Senior Advocate, said that the principles of multiparty democracy will not be disrupted just by letting the parliamentarians decide on their own.

He added that an individual failing to obtain the vote of confidence cannot remain on duty as the PM. Ghimire was of the view that the PM should quit the argument of ‘I am an option for myself’.

Senior Advocate Ghimire argued that the parliamentarians can give their vote of confidence independently to the PM elected as per Article 76 (5). The lawmakers are independent as per Article 76 (5) and can give the vote to the prime minister’s candidate of their choice.
